AG of California Unsuccessfully Sues Delta Airlines for Failing to Include a Mobile Privacy Policy on its App

delta-airlines-3For reasons unrelated to lack of compliance with Privacy laws and regulation, the Court in the State of California dismissed the Attorney Genera’s claim that Delta Air Lines violted California’s Online Privacy Protection Act for failing to include a mobile privacy policy for its mobile application.  The law suit was initiated as part of a privacy enforcement campaign that began with the issuance of warning letters to over 100 operators of mobile apps. The basis for the dismissal was the federal Airline Deregulation Act, under which a state “may not enact or enforce a law, regulation, or other provision having the force and effect of law related to a price, route, or service of an air carrier that may provide air transportation under this subpart.”
